Innovative Approaches to Post-Conviction Relief

Javier Diaz

Post-conviction relief is often seen as a long, uphill battle. But sometimes, the key to success is thinking outside the box and collaborating creatively.

Recently, I’ve been able to negotiate directly with district attorneys and work with other agencies to resolve post-conviction cases and address collateral consequences for my clients.

These efforts have led to meaningful solutions—ones that go beyond traditional legal remedies to help clients reclaim their lives. For example:

  • I renegotiated probation conditions that were limiting a client’s job prospects, paving the way for better career opportunities.

  • I worked with a government agency to help a client secure a much-needed certification despite a prior conviction.

  • I reworked a plea deal when the jail time turned out to be different from what was initially expected, ensuring a fair outcome.

Part of my mission at my firm is to find cost-effective solutions. In each of these cases, we could have litigated to get the same result, but that would have taken longer and been significantly more expensive for my clients. By negotiating and collaborating, we achieved meaningful outcomes efficiently and affordably.
